Inductive Brain is a simplified joint-stock company with variable capital, registered in the Grenoble Trade and Companies Register under number 903 505 212, with its head office at 30 rue des Trembles, 38100 La Tronche, represented by Mr. Vivien HENRY in his capacity as President (hereinafter referred to as the "Company" or by its commercial brand "Microforge").
"User" refers to the adult individual who participates in a workshop.
"Client" refers to the natural or legal person who places the order and settles the total amount requested. This can be the User.
These General Terms and Conditions of Sale determine the conditions for training and sales organized by Inductive Brain SAS or its service providers.
Any order for training, courses, workshops, or finished products from the Company or one of its service providers implies the Client's acceptance and signature without reservation of these General Terms and Conditions of Sale.
Microforge aims to promote plastic recycling and soft mobility. In this context, the Company offers workshops for making bicycle trailers and direct sales of bicycle trailers.
It welcomes individuals (hereinafter referred to as "Users") wishing to benefit from the know-how, tools, and means of Microforge.
The Company thus provides Users with tools, skills, and technical means enabling them to build a trailer themselves.
The Company also offers direct sales or orders of trailers.
The purpose of this contract (hereinafter referred to as the "Contract") is to define the terms and conditions under which the Parties will collaborate.
The Company reserves the right to modify its General Terms and Conditions at any time. In case of modification, the applicable General Terms and Conditions are those in effect on the date of the order or issuance of the signed quote by the consumer, a dated copy of which can be provided to the consumer upon request.
The nullity of a contractual clause does not entail the nullity of the General Terms and Conditions, unless it is an essential and determining clause that led one of the parties to conclude the present contract.
The temporary or permanent non-application of one or more clauses of the General Terms and Conditions by Inductive Brain does not constitute a waiver of the other clauses of the General Terms and Conditions, which continue to have effect.
The General Terms and Conditions are enforceable against the consumer, who acknowledges having read and accepted them before placing an order.
The validation of the order by its confirmation or the signature of the quote constitutes acceptance without reservation by the buyer of the General Terms and Conditions in effect on the date of the order, the preservation and reproduction of which are ensured by the Company in accordance with Article 1369-4 of the Civil Code.
The trailers are handmade bicycle trailers, manufactured by Inductive Brain or its service providers, or made by the trainee.
They are mainly made of steel and wood. An attachment to be fixed on the bicycle is provided. (One attachment per bicycle is necessary, and each additional attachment is sold for 15€ TTC)
There are 3 standard models: "Flatbed," "Circular," and "Box," which can be declined in 3 different sizes: 75x50cm (S), 75x60cm (M), and 100x60cm (L). There are also 2 three-wheeled models, "PUMBA," in "Circular" and "Box" versions, which can be declined in 2 different sizes: 140x65cm (XL) and 165x80cm (XXL).
Depending on the needs, the model can be modified according to the specifications given by the customer, following acceptance by the Company and the preparation of a quote. The new price is defined by the Company when preparing the quote, with the Client being free to accept this quote or not.
The Company offers bicycle trailer manufacturing workshops in its Grenoble workshop.
The workshop is organized over two days, the dates of which are announced in advance and reserved by the Client via the website microforge.fr, its reservation platform ateliers.microforge.fr, or by email at contact (a) microforge.fr.
All materials are provided, including raw materials, tools, and personal protective equipment. The User is only required to bring thick cotton clothing and thick shoes. The User is informed that these clothes may be damaged or degraded during the workshop, without the Company being held responsible.
The Company and its service providers are committed to ensuring the safety of individuals: explanations of risks at the beginning and during the workshop, compliant materials, and supervision during the workshop.
The User undertakes to follow the instructions given to the letter and to ensure their safety and that of other trainees: constant vigilance, use of machine tools in accordance with the rules, and use of the provided protective equipment.
The Company cannot be held responsible for injuries or accidents occurring during the workshop if the User does not follow the instructions or engages in dangerous activities for themselves or others.
The Client pre-registers via the online form or by email. This pre-registration results in the Company sending an information email containing technical and logistical arrangements and providing the company's bank details.
The Client must pay a deposit of 100€ within 5 days of pre-registration.
The workshops can only take place if all four spots are filled.
If the four spots are not filled 7 days before the workshop start date, the Company reserves the right to cancel the scheduled date. In this case, the User can either request a full refund of the deposit or reserve another date at no additional cost.
The workshops are conducted with four Users.
Custom workshops can be organized, in which case a quote will be prepared to define the terms and scope of the workshop.
The Company offers trailers for rent, subject to availability.
A deposit of 450€ and a copy of an ID are required.
Pick-up and return of trailers are by appointment, on weekdays, from 9 am to 6 pm.
The Company offers the use of workshop spaces.
The workshop availability is subject to the presence of an employee/company representative on-site.
The Client agrees to respect and sign the charter provided to them.
The table below defines the prices, in euros including all taxes, excluding delivery and transport costs, which will be indicated before validation of the order and invoiced separately. Any modification of the plans is subject to the preparation of a custom quote.

The group workshop is offered at the price of the chosen trailer plus 110 € TTC, in euros including all taxes. The individual workshop is offered at the price of the chosen trailer plus 180€ TTC, in euros including all taxes.
It includes the realization of the standard trailer, with a total of four trainees. The Company reserves the right to refuse a modification of the plans requested before or during a workshop.
One person can accompany another trainee if there are vacant spots. This service is offered at the price of 110 € TTC for the additional person.
Payments can be made by bank transfer to the account of Inductive Brain, by check payable to Inductive Brain, or online via Paypal (valid for workshop deposits).
4.1- For workshops, a deposit of 100€ is required within 5 days of pre-registration. The final payment is due upon delivery of the trailer.
4.2- For orders, a 30% deposit is required at the time of ordering. The Company commits to delivering the product within 30 days of acceptance of the quote.
4.3- For direct sales, in the case of in-stock merchandise, payment is required in full at the time of purchase.
4.4- Short-term rental is 12€ TTC/day for two-wheel trailers, 25€ TTC/day for PUMBA trailers.

4.6- Workshop availability rates:

It is possible to gift a workshop to a third party. In this case, the User and the Client are two different people.
The delivery date is defined with the client before the order.
It may happen that after validation of the order, the product can no longer be delivered within the initially planned deadlines.
In this case, Inductive Brain will inform the Client as soon as possible by registered mail with acknowledgment of receipt or by email and will offer them:
either to cancel their order,
or to wait by specifying a new delivery date.
If the Client does not agree to the extension of the delivery deadlines, the order will be canceled.
If the ordered products are not delivered within the agreed deadline, for any reason other than force majeure or the Client's fault, the contract may be terminated at the Client's written request under the conditions provided for in Articles L 216-2 L, 216-3, and L241-4 of the Consumer Code, by registered letter with acknowledgment of receipt to the following address:

The contract will be considered terminated upon receipt by Inductive Brain of the registered letter or email informing them of this termination, unless the professional has executed the order in the meantime.
The consumer will receive from Inductive Brain, within 14 days of receiving the contract termination request, a refund of their payment, excluding any compensation.
Delays in delivery cannot give rise to damages or retention.
The Client has a right of withdrawal of 14 days from the day after receiving the products. This right is only valid for catalog products purchased remotely. The Company will fully refund the Client once the product is returned within 14 days in its original packaging and without damage. The return shipment of the goods is at the Client's expense.
The right of withdrawal is NOT valid for (the Client accepts to lose their right of withdrawal):

The Company may cancel one or more orders in case of physical or material impossibility (e.g., flooding).
In this case, the Company will refund the Client the full amount paid.
The Company may cancel the Workshop in case of physical or material impossibility (e.g., flooding). In this case, Inductive Brain will refund the User the amounts paid or offer new workshop dates.
If the four spots are not filled 7 days before the workshop start date, the Company reserves the right to cancel the scheduled date. In this case, the User can either request a full refund of the deposit or reserve another date at no additional cost.
In case of cancellation of the Workshop for any reason other than those mentioned above, the users will be informed and refunded the full amount paid. 8.12- Cancellation by the User. 8.12.1- Products
In-stock products purchased in-store cannot be canceled or refunded under any circumstances.
The client is committed by signing the quote in case of an order; If the Client cancels an order placed in-store despite this, the Company reserves the right to retain the deposits paid as compensation.
By validating their registration, the participant commits definitively. The realization of the proposed workshop is subject to a minimum number of participants. The service offered by Inductive Brain incurs costs to the Company's activity. Inductive Brain cannot, therefore, accept cancellations by the User without retaining compensation.
Thus, when the cancellation is due solely to the User, whatever the reason, Inductive Brain will retain the deposit paid by the User as compensation. 8.13- Postponement by the User.
If the User wishes to postpone their Workshop to another date, this can be done without penalty up to 20 days before the start date.
There are two possibilities: either the User wishes to complete the product themselves, in which case the Company and the User will define the hours during which the User can continue to use the equipment provided during the workshop. (limited to 6 cumulative hours, within 4 weeks following the workshop, and during the time slot 9 am-8 pm, Monday to Saturday)
In the other case, if the User does not wish to complete the trailer themselves and assigns the Company to this task, the Company reserves the right, depending on the task's scope, to charge up to an additional 20€, corresponding to the value of the ordered trailer.
By confirming their registration, the User acknowledges not suffering from any illness, disability, or allergy incompatible with the proper conduct of the workshop given their health condition. They commit to following safety instructions, including wearing certain accessories such as protective glasses, following the usage advice for products or tools and equipment given by the trainer. Each User must verify that they are personally covered for the chosen activity.
The Users are adult individuals.
The products provided by the Company benefit from the legal guarantee of conformity for apparently defective, damaged, or non-compliant products with the order, and the legal guarantee against hidden defects resulting from a material, design, or manufacturing defect affecting the delivered products and making them unfit for use.
The Client can decide to implement the guarantee against hidden defects of the product according to Article 1641 of the Civil Code. In this case, they can choose between the cancellation of the sale or a reduction of the sale price according to Article 1644 of the Civil Code.
To assert their rights, the Client must inform the Company in writing of the non-conformity of the products within a maximum of 2 years from the delivery of the products or the discovery of the hidden defects and return the defective products in the state in which they were received with all elements (accessories, packaging, instructions...).
The Company will refund, replace, or repair the products under warranty found to be non-conforming or defective. Shipping costs will be refunded based on the invoiced rate, and return costs will be refunded upon presentation of receipts.
Refunds for products found to be non-conforming or defective will be made as soon as possible and at the latest within 14 days following the Company's determination of the non-conformity or hidden defect.
Excluded from the warranty are defects and damage caused by:
abnormal use of the products not corresponding to the Company's instructions;
normal wear and tear of the products (wear parts such as tires or elastics);
modification of the product not provided or specified by the Company;
improper storage;
negligence;
lack of maintenance or insufficient maintenance;
superficial and non-compliant cleaning with the instructions given at the time of sale;
breakage of the material for a reason other than a manufacturing defect;
on the part of the Client, such as in the case of an accident, fire, water damage, or force majeure.
The Seller's warranty is, in any case, limited to the repair, replacement, or refund of non-conforming or defective products.
Products damaged or incomplete due to the Client are not covered under the warranty.
The product must be accompanied by the invoice or, failing that, a free paper indicating the consumer's first and last name and the order number.
The warranty does not cover cases where a defect apparent at the time of receipt of the goods has not been reported by the client.
The Company will not be held responsible in case of an accident, physical injury to a person or third party, or material damage following the use of the trailer.
The purpose of this Article is to define the conditions under which the Parties undertake to carry out personal data processing operations necessary for the proper performance of their obligations under the Contract.
Each Party undertakes to comply with all applicable legislative and regulatory provisions on data protection, provided in particular by the General Data Protection Regulation (EU) No. 2016/679 on the protection of individuals regarding personal data and the free movement of such data (hereinafter referred to as the "GDPR"), as well as any other text that may amend, supplement, or replace them in their capacity as Data Controller.
Under the Contract, each Party will have the status of data controller and will remain, in all cases, the owner of the data processed under the Contract.
The personal data collected by ateliers.microforge.fr, for example during registration for workshops, is used to process your order.
The Company reserves the right to revise these General Terms and Conditions to adapt to its technological and commercial environment and comply with current regulations.
